She'd had enough

When Naperville resident Susan Miller went outside a few weeks ago and stepped in dog excrement-barefoot she reacted. She allegedly wiped it on the deck of her neighbors' apartment. She also put the sign there reminding dog owners to clean up after their pets. Now she faces disorderly conduct charges.
What would you have done if you were in her shoes?

I think it was very responsible of her to return it to the owners. Also, can we have the name of the apartment complex?

Maybe you would be alarmed and disturbed, but would a judge or a jury of her peers be alarmed and disturbed? Besides it wasn't wiped on the house, it was wiped on deck. Should we be any less alarmed or disturbed if we see someone walking a dog and not cleaning up after their pet? Dog crap in one spot is no more disturbing or alarming than in another.

Back in the day when I was just a kid my father used to tell me stories of how they would handle such a situation in his "old neighborhood". The would collect the dog crap for several days in a paper bag. Then they would put the paper bag on the front steps, set it on fire, ring the doorbell, and then take off. Then they would get a good laugh when the dog owner opened the door and stepped on the paper bad to put out the fire. These days there are to many weak kneed cops and lily livered prosecutors out there that they would probably consider something like that disturbing or alarming.

However, the real question in this case is whether or not what she did was an unreasonable act? There are actually quite a few people who think the act of returning an item, even if it is dog crap, to the rightful owner, which the rightful owner illegally dumped where it didn't belong, is not an unreasonable act and instead represents excellent civic pride and citizenship. Reasonable people do not want someone living among them who create an unhealthy or unsanitary environment where it becomes a nuisance to other people and children.

Both the Naperville Police Department and the apartment complex should be ashamed in how they handled this situation. The fact that the Naperville Police Department didn't charge the dog walker with multiple violations of the dog walking ordinance speaks for itself in terms of objectivity, decency, and basic fairness. The fact that the apartment complex would rather try to evict someone who cares about how the property and grounds looks over another tenant who openly thumbs her nose at both city ordinances and apartment complex rules speaks volumes about their lack of common sense and good management. Despite the hassle of being evicted and the additional hassle and cost of moving she really would be better off living in an another apartment complex that is run by competent management.

Ken advises Susan Miller to sue NPD for false arrest????? OK Kenny Boy, I will give you Law 101. Disorderly Conduct is any unreasonable act that alarms or disturbs and causes a breach of peace. I think if someone wipe dog crap on your house, you would be alarmed and disturbed!!!!

What a joke. She wipes the offending poop off on the offender's deck, and she gets arrested? I'd be considering a lawsuit for false arrest against the police and pain and suffering against the neighbor and apartment complex if I were her.

In the finest tradition of the Naperville Police Department they charged Ms. Miller with disorderly conduct and did nothing against the dog owner who did not clean up after her dog.

Even the apartment complex isn't enforcing their own rules with the dog owner and instead are trying to evict her. Sounds like Ms. Miller should have a good chance beating the eviction considering the apartment complex can't choose to enforce some rules and not others.

I'm sure glad I don't have to live in that apartment complex and am growing more and more dissatisfied with living in Naperville because of how a growing number of issues are handled.

I walk my dog twice a day and clean up after it. During my walks past several apartment complexes I frequently see owners coming out of their apartments and heading to nearby parks and schools who do not clean up after their dogs even though waste containers are available.

Dog waste not being properly removed is a growing problem by irresponsible dog owners and no one is doing anything about it. Ms. Miller shouldn't have to worry about stepping in dog waste outside her apartment, barefoot or otherwise, nor should children playing in parks or school yards.

If we can afford to put our highly paid and over educated Naperville Police Officers on "pee patrol" in downtown alleyways trying to catch those who our highly respectable business community has allowed to imbibe to the point where their patrons loose good judgement on where to properly urinate then these same seasoned and experienced officers should be able to put their highly honed skills to good use catching all of the four legged perpetrators out there.

If not, then the Naperville Police and this apartment complex ought to take a deep breath and just let this go. If and when someone gets fed up with dog waste to the point where they take a swing at someone then maybe, maybe the police need to become involved. Until then, the Naperville Police would have been far better off to tell the dog owner when she complained... "Gee, maybe you should stop being a thoughtless, irresponsible creep of a neighbor and start cleaning up after your dog.... because if you don't we are going to have to charge YOU!"
