A friend of mine who has a ¾ ton pick up truck was recently ticketed for not having emergency/safety equipment in
his truck (flares, fire extinguisher, flags and safety sticker). The officer told him that this is an obscure law that the state (Illinois) is now going to start to enforce, he uses his truck for business and personal use. I am asking because we have a ¾ ton pick up truck that is used for business and personal as well as a business van that is also a ¾ ton and I can not find any information on a law like this.
Can you help me find this information?

Hello Kari,
The determiner for the laws you are speaking of is the Gross Vehicle Weight Rating of the vehicle. You should be able to find this rating either on a plate affixed to the door of the truck, or in the owner's manual. if the vehicle has a GVWR of more than 8000 lbs, it is considered a second division vehicle and is then bound by these laws.
The sections of the law are 625 ILCS 12-702 for Flares & Flags, and 625 ILCS 13-101 for Safety Tests. You can look at the wording online at http://www.ilga.gov/legislation/ilcs/ilcs2.asp?ChapterID=49 , Then click on the top selection "Illinois Vehicle Code", and navigate to the above sections of the law.
